Mayor Malcolm Brodie opened the proceedings at 7:00 p.m.

 

 

 

1.

ZONING AMENDMENT BYLAW 8130 (RZ 06-329755)

(10351 Aragon Road; Applicant:  Samuel Yau)

 

 

Applicant’s Comments:

 

 

The applicant was present to answer questions.

Gerry Alblas, 10291 Aragon Road expressed his disagreement with coach houses generally and explained that this proposed development will give him an unappealing view of the coach house on top of the garage. He was concerned the coach house will appear to be encroaching on the neighbourhood and will be too tall for the site. He further noted that being a rental suite, it cannot be defined as a true neighbour and is unsuitable for his neighbourhood.

 

 

Several questions were raised about coach homes. In response Mr. Jean Lamontagne, Director of Development provided the following advice:

 

 

§          

the current lot size policy allows for R1.06 or R9, which is the coach house development;

 

 

§          

there are no other coach homes in the Williams Road area, and this proposal would be the first if approved by Council;

 

 

§          

roof pitch of the building scheme will play a factor in the height of the structure;

 

 

§          

design details are not available to staff until the Development Permit process, however the height of the coach house would not exceed the height of the main house.

 

 

Discussion ensued amongst Council and staff regarding the height and site lines of the coach home, and Mr. Lamontagne indicated that a registered building scheme could be put into place addressing Council’s comments as a conditional requirement before final approval.

 

 

It was noted that prior to Council’s adoption of Lot Size Policy 5443, which took place in December 2006, public consultation showed support from a majority of the area residents.

 

 

The applicant then joined the discussion, and referring to several schemes and pictures, advised that the proposed coach home reflects a traditional house and will not block other homes. The building will not have a balcony or window on the back side and will be lower in height than the main house with a variance of approximately three feet between the two homes. He also indicated that the coach house is considered to provide affordable housing.

 

 

In answer to a question about developing the coach house without covering the majority of the lot, Mr. Lamontagne advised that the coach house will be at the corner of Aragon and the back lane, and corner lots have to provide a wider side yard.

ZONING AMENDMENT BYLAW 8179 (RZ 04-272735) AND RELATED BYLAW 7976 HIGHWAY CLOSURE AND REMOVAL OF HIGHWAY DEDICATION

(8400 and 8440 Anderson Road, a portion of Anderson Road, and a 158 m2 area of surplus City land; Applicant:  Patrick Cotter Architect Inc.)

Submissions from the floor:

 

 

Russ Brown, 8500 Anderson Road spoke against the proposal, concerned about removal of trees, the impact of increased density on the neighbourhood’s elementary school, and the additional vehicles in the area. Mr. Brown referred to several pictures of the development site showing parked vehicles, and garbage strewn on it. He noted that the site is not fenced off and many bylaw infringements have taken place.

 

 

In answer to several questions about the site, Mr. Lamontagne provided the following advice:

 

 

§          

the development will be subject to the tree replacement program, and a detailed landscape plan will be available at the Development Permit stage;

 

 

§          

the Bylaw Division will be asked to investigate any infringements upon bylaw 6366, Boulevard and Roadway Protection Bylaw;

 

 

§          

there is no requirement for the Developer to provide a temporary fence;

 

 

§          

the proposal has been reviewed by the Transportation Department and the parking requirements have been supported;

 

 

§          

at this time the proposed development is in conformity with the projections of the School Board’s study for this area; and

 

 

§          

the residents within 50 meters of the development will receive notification during the Development Permit process;

 

 

§          

mature trees are defined in the Official Community Plan as being 15cm in diameter.

 

 

In response to a question, Edward Abboud and Gary Fields of Patrick Cotter Architect Inc. indicated that the affordable housing units will be approximately 488 square feet in size, located on the first and second levels.

Doug Parmenter, 9571 Ferndale Road expressed his concern that approval of this proposal will set a precedent along Ferndale Road enabling other residents to make similar applications. He then asked if he would be allowed to make a similar application.

 

 

In answer to Mr. Parmenter’s comments, advice was provided that any property owners may submit a rezoning application, and the review process considers each application on it’s own merits.

 

 

In answer to a question about emergency vehicle accessibility on this street, Jean Lamontagne advised that each application is reviewed by the Fire Department to ensure emergency vehicle access points are adequate.

 

 

Direction was given to staff to have the Fire Department provide confirmation that parked vehicles along the road would not be obstructing accessibility for emergency vehicles.
