Mayor Malcolm D. Brodie opened the proceedings at 7:00 p.m.

Zoning Amendment Bylaw 7946 (RZ 05-298445)

(3180 Granville Street; Applicant:  Parminder Rishi)

 

 

Applicant’s Comments:

 

 

The applicant advised that he was available to answer questions.

In response to a query from Council, Mr. Burke, Acting Director, Development, advised that trees could be planted after the houses were constructed. The letter of credit ensured that when the trees were planted they were healthy and would remain so for a period of time.

Submissions from the floor:

 

 

Ms. Olive Bassett, Chair, Richmond Seniors Advisory Committee, spoke in support of this project.  She noted that the Committee believes this development will provide a much needed facility for the City’s growing senior population.

 

 

Mr. Robert Breen, 12032 Osprey Court, spoke in support of this project.  He then enquired about the rezoning of this site, and what it would mean in the future if it proved to be too small;

 the definition of accessory use; whether the pedestrian path to Moncton Street would be made available during construction;  how preloading would impact on properties surrounding the site; and how parking would be addressed during construction.

 

 

In response to these queries, Mr. Burke advised that the zoning on this site limited the number of beds which could be provided; accessory use was limited to sheds and did not include cell towers; the developer would be responsible for the pathway and for drainage on site; and the Transportation Department required a traffic management plan from the applicant, and that this would be addressed prior to the building permit stage.

 

 

Ms. K. Janssen, 11960 Flamingo Court, spoke in support of the project.  She stated her concerns about noise management during construction and vibrations which would occur during preloading.

 

 

In response to a query from Council, Mr. Burke advised the City’s Noise Bylaw regulated construction hours. 

 

 

Mr. Doug Purdy, Applicant, introduced his associate, and advised that the developer’s objective was to keep the pedestrian path open; however, it would be inaccessible during the time topsoil was scheduled to be removed.  He also stated that the path would be moved to the perimeter of the site.

 

 

In response to queries from Council, Mr. Purdy advised that he would be consulting with residents concerning noise and damage during preloading and compacting;  the pedestrian path would not be directly illuminated but would be illuminated by lighting from the buildings and the parking lot; a parking management plan would ensure that there would be no parking problems due to construction.

Applicant’s Comments:

 

 

The applicant stated that he was available to answer questions.

Submissions from the floor:

 

 

Mr. and Mrs. Wood, 22880 Westminster Highway.  Mrs. Wood expressed concerns about preloading and the effects this would have on her garden.  She was also concerned about loss of privacy.

 

 

In response to a query from Council, Mr. Burke advised that Mrs. Wood’s privacy should not be affected as there was a 20’ setback from the property line.

 

 

Mr. Wood enquired whether his house would be allowed to connect to the development’s sewer line, and if the trees adjacent to his property would be removed.

 

 

Mr. Burke advised that neighbouring properties could be hooked up to the sewer line at their own cost.  He also advised that staff would work with the applicant and Mr. & Mrs. Wood concerning the removal of trees abutting their property line.

 

 

Ms. Eva Sun, 22740 Westminster Highway enquired about responsibility for damage during construction, availability of parking and how this would be addressed; flooding after preloading; the ditch in the ESA area which was polluted by landfill and whether landfill would also be used on this site; and her ability to connect her house to the sewer line,

 

 

In response to these concerns, Mr. Burke advised that the developer would have to work with residents to minimize damage during construction;  the on site parking meets the City’s parking requirements; the site has to be raised because of floodplain requirements. He noted this would elevate the site above neighbouring properties and stated that the developer would be responsible for drainage of the site;  the Transportation Department required a construction management plan to ensure parking would be regulated during construction.  He also stated that the City intended to maintain and upgrade the ESA area.

 

 

In response to a query from Council, Mr. Burke advised that a retaining wall for the ESA area would be addressed during the Development Permit Process and stated that residents in the area would be notified of the date of the DPP meeting.

 

 

Mr. Kush Panatch, representing Centro Developments; advised that an arborist had been employed to examine tree retention;.  there was a 50’ setback from the ESA canal to the development;  landscaping on the site would ensure that there was privacy to properties abutting the site; the site would be elevated with landfill; a consultant and a geotechnical engineer had been retained to discuss the impact on the water table, and to monitor damage to properties during landfill; and during construction, parking for workers would be accommodated on site.  In response to a query from Council, he advised that he would consult with the Woods concerning the trees abutting their property.

 

 

Mr. Horst Hinz, 22900 Westminster Highway, stated that he would like to have his house connected to the development’s sewer line as well.

In response to queries from Council, Mr. Burke advised that accessibility issues would be addressed during the development permit process.  He also advised that monies had been previously collected for the cost of roads and developers were reimbursed when these were built.
