Opportunity for Business Licence Holder to be heard in accordance with Section 60 of the Community Charter – Representative of Dream Garden Supplies. | ||
|
|
Chief Licence Inspector, Amarjeet Rattan, advised that a representative of Dream Garden Supplies would not be in attendance as they had accepted the cancellation of the business license. He further advised that Dream Garden Supplies had written a letter requesting a refund upon the cancellation of their business licence. | ||

That the business licence for Dream Garden Supplies located at 11579 Bridgeport Road, Richmond, B.C. be revoked for the following reason(s): | |

(a) |
An inspection of the business premises by the Richmond RCMP on August 11, 2007, revealed marijuana clone plants, bags of loose marijuana and the remnants of an apparent grow op room. |
|
|
|
(b) |
It was ascertained that, on August 28, 2007, Dream Garden Supplies was operating with an invalid business licence, contrary to section 4.1.1 of the Business Licence Bylaw No 7360. |
|
|
|
(c) |
City of Richmond Building and Plumbing Inspectors attended this location and found numerous building code deficiencies connected with the premises. |
|
|
(2) |
In accordance with the authority granted under the Community Charter Sec. 60 (2), the City deems that by failing to maintain the standard of qualification required for the issuance of a City Business Licence, this business has violated section 5.1 of the Business Licence Bylaw No 7360, section 22.1 of the Business Licence Regulations Bylaw No 7538 and section 14.1 of the Building Regulation Bylaw No 7230. | |

The question on the motion was not called, as in response to questions, advice was given by Mr. Rattan that although the RCMP had found marijuana plants on the premises of Dream Garden Supplies, they did not have enough evidence to lay charges, and that when questioned, a representative of Dream Garden Supplies stated that the plants may have belonged to a client who had been on the premises to purchase supplies. | ||

In response to a question about when and if the representatives from Dream Garden Supplies could apply for a new business licence under a different company name, Mr. Rattan advised that the City does not have an applicable time limit associated with cancellations of business licences, and that staff would monitor any new business licence applications for a similar business by anyone associated with Dream Garden Supplies. | ||

Failing to maintain its proper name and address on both sides of a vehicle used in connection with its business, in contravention of Business Regulation Bylaw No. 7538, Part Nineteen, Scrap Metal Dealer, Second Hand Dealer and Pawnbroker Regulations, Section 19.8(b) |

(2) |
Purchase of scrap metal items offsite from its business premises, in contravention of Business Regulation Bylaw No. 7538, Part Nineteen, Scrap Metal Dealer, Second Hand Dealer and Pawnbroker Regulations, Section 19.9 (a). |
