Wayne G. Mercer, Manager, Community Bylaws and Magda Laljee, Supervisor, Community Bylaws provided the most recent set of pictures of the property at 10791 Bird Road, taken on Monday, September 12, 2011 (on file City Clerks Office), and Ms. Laljee indicated that the site remains unsightly. |

Robert Harlos, property owner, 10791 Bird Road, spoke to Council about his effort to clean the property, and indicated that he had recently taken time off work to deal with the matter. Mr. Harlos requested an extension of approximately two weeks to complete the clean up, and noted that one of the vehicles on the property had been given away, and arrangements for off-site storage had been made for the other vehicles. |

Discussion took place about granting the requested extension. Members of Council made various comments regarding the general clean up, removal of vehicles and recycling, noting that Mr. Harlos’ property was not as unsightly as some others that have been dealt with previously. |

That after September 30th, 2011, Walden Disposal Services, as contractor for the City, be authorized to remove and dispose of all discarded materials at 10791 Bird Road, Richmond, in accordance with the “Order to Comply” dated June 28, 2011 issued under the Unsightly Premises Bylaw No. 7162 and section 17(1) of the Community Charter; and |

(2) |
That the final cost of this removal and disposal, estimated at $4,502.04 (including fees and taxes), be invoiced to the registered owners of the property located at 10791 Bird Road. |

The question on Resolution No. SP11/9-1 was not called, as in answer to a question, staff advised that: (i) should Mr. Harlos be unable to complete the clean up of the property by September 30th, 2011, and the services of Walden Disposal Services are required, Mr. Harlos would be billed the amount of the invoice; (ii) if Mr. Harlos partially cleans up the property, and Walden Disposal Services completes the clean up, the invoice will be adjusted accordingly; (iii) if the outstanding invoice is not paid in full by Mr. Harlo by the end of the calendar year, it will be added to the property taxes for 10791 Bird Road; and (iv) the Bylaw Department works with the Taxation Department to put a note on the property file to ensure that an invoice is paid prior to sale of a property, should the property be sold in the meantime. |

Ms. Laljee indicated that although the property owner had made some progress in cleaning the property, the matter had been ongoing for approximately one year. |

Greg McDermid, property owner, 23440 Gates Avenue, was accompanied by his son, Kevin McDermid, who advised that: |

his father, (Greg McDermid) relied on him a great deal. However, he (Kevin McDermid) had had several medical issues and injuries since 2007, that had made it difficult to physically work until recently; |
| ||

progress had been made in cleaning up the yard, and many of the vehicles had been moved; |
| ||

many of the items shown in the pictures are not visible to neighbours; and |
| ||
|
|

the family wanted the privilege to clean up their own yard, and needed an extension until the end of November, 2011. |

Discussion ensued about recycling and disposing of particular items on the property, and about granting the requested extension. |

That the final cost of this removal and disposal, estimated at $5,414.27 (including fees and taxes), be invoiced to the registered owners of the property located at 23440 Gates Avenue. |
