Site Clean Up of an Unsightly Property, Civic Address: 11460 Seabay Road, Legal Description: Lot 13, Section 36-4-6, Plan 19945

Jodie Shebib, Supervisor Community Bylaws circulated a set of photos of the unsightly property at 11460 Seabay Road, Richmond taken on Monday, April 7, 2008 (on file in the Clerk’s Office) and advised that the photos were a result of an inspection by City staff. She noted that although there has been some improvement in the appearance of the property since the March 3, 2008 Special Council Meeting, the property remains unsightly.

 

 

 

Ulf Areskoug, owner of 11460 Seabay Road explained that the property had been cleaned up and that the items on the property were not discarded but were the result of work done on a fence on his property. In reply to a query from Committee, he further noted that some wood on his property is used as fire starter material.

 

 

 

Discussion continued among Committee, Ms. Shebib, and Wayne Mercer, Manager, Community Bylaws, and staff advised that the cost to remove discarded materials from 11460 Seabay Road would accurately reflect the amount of material removed, and the initial proposed cost of $1,174.72 would be adjusted accordingly to reflect the slight improvement to the property’s appearance since the March 3, 2008 Special Council Meeting.

It was moved and seconded

 

 

That:

 

 

 

(1)

That the appeal submitted by Ulf Areskoug, (owner of 11460 Seabay Road, Richmond) against the “Order to Comply” issued on November 20, 2007 regarding the condition of his property under the Unsightly Premises Regulation Bylaw No. 7162 and section 17(1) of the Community Charter, be denied; and

 

 

 

(2)

That the City’s contractor, Walden Disposal and Tractor Service, be authorized to remove all of the discarded materials at 11460 Seabay Road, Richmond, in accordance with the “Order to Comply” of November 20, 2007 issued under the Unsightly Premises Bylaw No. 7162 and section 17(1) of the Community Charter, at a cost of $1,174.72 to be recovered from the property owner.

 

 

 

The question on the motion was not called as staff responded to further queries from Committee. Staff advised that:

 

 

 

·         

if Council decided that the property was unsightly and that the City’s contractor was authorized to remove the discarded materials that remain on the property, the necessary steps would be taken within a day or two following Council taking that decision;

 

 

 

·         

discarded material around the trailer would be removed; and

 

 

 

·         

the owner’s materials that are in the car port would not be removed.

 

 

 

The question on the motion was then called and it was CARRIED.
