Call to Order:

Mayor Brodie called the meeting to order in open session at 4:00 p.m.

AGENDA ADDITIONS; CLOSURE OF THE COUNCIL MEETING TO THE PUBLIC AND COMPLIANCE WITH THE COMMUNITY CHARTER CLOSED MEETING CRITERIA

It was moved and seconded

 

 

(1)

That the following matters be added to the agenda as Items 3 and 4 respectively:

 

 

 

(a)

legal advice regarding the motion being brought forward by Councillor Steves; and

 

 

 

(b)

an update from the Chief Administrative Officer on (i) the DFO property, and (ii) the Trade & Exhibition Centre; and

 

 

(2)

Council hereby declares that the meeting held at 4:00 p.m. on Tuesday, September 6th, 2005 is to be closed to the public and that the basis of this closure is that the following items on the agenda of this meeting comply with the following closed meeting criteria specified in Section 90 of the Community Charter:

 

 

 

Item 1

90(1)(a) - personal information about an identifiable individual who holds or is being considered for a position as an officer, employee or agent of the municipality or another position appointed by the municipality;

 

 

 

Item 2

90(1)(b) - personal information about an identifiable individual who is being considered for a municipal award or honour, or who has offered to provide a gift to the municipality on condition of anonymity;

 

 

 

Item 3

90(1)(g) – litigation or potential litigation affecting the municipality; and

 

 

 

 

the receipt of advice that is subject to solicitor-client privilege, including communications necessary for that purpose; and

 

 

 

Item 4

90(1)(e) - the acquisition, disposition or expropriation of land or improvements, if the council considers that disclosure could reasonably be expected to harm the interests of the municipality.
