Mayor Brodie called the meeting to order in open session at 4:00 p.m.

It was moved and seconded

That oral report from the City Solicitor regarding Post Public Hearing submissions, be added to the agenda as Item 2, and that Item 2 be renumbered as Item 3; and

(2)

Council hereby declares that the meeting held at 4:00 p.m. on Monday, February 23^rd, 2004 is to be closed to the public and that the basis of this closure is that the following items on the agenda of this meeting comply with the following closed meeting criteria specified in Section 90 of the Community Charter:
 

Item  1

90(1)(e) - the acquisition, disposition or expropriation of land or improvements, if the council considers that disclosure could reasonably be expected to harm the interests of the municipality; and
 

Item 2

90(1)(i) - the receipt of advice that is subject to solicitor-client privilege, including communications necessary for that purpose;
 

Item 3

90(1)(e) - the acquisition, disposition or expropriation of land or improvements, if the council considers that disclosure could reasonably be expected to harm the interests of the municipality; and

90(1)(g) litigation or potential litigation affecting the municipality.
