Delegations from the floor on Agenda items -

Item No. 10 - Animal Control Regulations

Ms. Karen Lau, representing the Western Federation of Dog Owners (FIDO), voiced concerns about the proposed definition for vicious dog being breed specific. She stated that instead of targeting specific breeds, all dogs should be treated equally, and she urged Council to remove the breed specific definition from the proposed Animal, Bird & Beekeeping Regulation Bylaw 7137. Ms. Lau advised that Provincial regulations would soon be enacted which would make the City's proposed vicious dog regulations unnecessary, and she suggested that a more pro-active education program would be more successful to alert dog owners on the need to control their animals.

Ms. Frances Clark, 8160 Railway Avenue, expressed concern that (i) the American Pit Bull Terrrier and American Strafordshire Terrier had been included in the definition of vicious dog as in her opinion, these breeds were not vicious in nature, and (ii) the difficulties which would arise about legally identifying the breed of a particular dog. She suggested that stronger penalties would be a better deterrent to owners who do not properly control their dogs.

Item No. 11 - Amendments to Bylaws Relating to Massage Therapists and Related Businesses

Ms. Penny Green, of 1959 West 2nd Avenue, Vancouver, stated that since Business Regulation Amendment Bylaw No. 7135 had been deleted from the Council agenda and referred to the next meeting of the General Purposes Committee for further review, that Council also refer Municipal Ticket Information Authorization Bylaw No. 7149 as the bylaw contained fines for offences relating to body rub parlours, which would soon be subject of a Supreme Court appeal by her clients.

Item No. 10 - Animal Control Regulations

Mr. Gordon Kibble, 11171 Fourth Avenue, voiced support for the proposed Animal, Bird & Beekeeping Bylaw, No. 7135, and in particular, for the definition of vicious dog.

That a letter be sent to the Honourable Joan Sawicki and to the Honourable Corky Evans to make them aware of the September 17, 2000 deadline date regarding the demolition of the Phoenix, Imperial and Brunswick Canneries, and to request that the Provincial Government make their intentions towards these buildings known by that date, in order that a possible request for their demolition can be considered in light of this information.

ANIMAL CONTROL REGULATIONS

That the following bylaws, which together address a number of outstanding animal control issues, especially with regard to dogs, each be introduced and given first, second, and third readings:

(1)

Animal, Bird, and Beekeeping Bylaw 7137;

(2)

Municipal Ticket Information Authorization Bylaw 7139; and

(3)

Public Health Protection Bylaw 6989, Amendment Bylaw 7140.

The question on Resolution No. R00/13-10 was not called, as the following amendment was introduced:

That Bylaw 7138 be amended by:

(a)

deleting the figure "3.2.4" in clause (b) of the definition "Running at Large", and by substituting the figure "2.2.4"; and

(2)

deleting the existing definition of vicious dogs, and by substituting the following:

"means

(a)

any dog that has killed or injured

:

(i) any person; or

(ii) another animal while running at large; or

(b)

any dog that aggressively harasses or pursues another person or animal while running at large; or

(c)

any dog primarily owned or in part for the purpose of dog fighting or is trained for dog fighting; or

(d)

a Pit Bull Terrier, American Pit Bull Terrier, Pit Bull, Staffordshire Bull Terrier, American Staffordshire Terrier, or any dog of mixed breeding which includes any of these breeds; or any dog which has the appearance and physical characteristics predominantly conforming to the standards for any of the above breeds."

That Bylaw 7149, which amends the Municipal Ticket Information Authorization Bylaw to add the ability to issue tickets for offences to the Massage Parlour and Body-Rub Parlour Regulations. be introduced and given first, second and third readings.

EVENT REGULATION (RAVES) BYLAW NO. 7141 AND BONDING REQUIREMENT

(1)

That Bylaw 7141, which establishes new regulations for Rave Events, be introduced and given first, second and third readings, without including the requirements for bonding of either the promoters or owners of the facility that acts as a venue for Rave Events.

(2)

That staff be instructed to review the licence requirements of those involved in Rave Events to determine whether or not the provisions of insurance and bonding should be a requirement of the obtaining of a business licence and/or a permit for a Rave Event.

(3)

That staff be requested to review in general terms, those "rave-like events" which take place earlier in the evening and end by 2:00 a.m.

CONSULTATION PROCESS - DRAFT VANCOUVER INTERNATIONAL AIRPORT (YVR) LAND MANAGEMENT POLICY

a recommendation be made to the Vancouver International Airport Authority (YVRAA) Board that it supplement its current consultations regarding the draft YVR land management policy, as per the Manager, Land Use report dated June 16, 2000, and

the YVRAA be advised that the City declines to comment on the substance of the draft YVR land management policy.

BRITANNIA HERITAGE SHIPYARD - CONTRACT WITH MAKAM CONSTRUCTION

That a contract for the Structural upgrade and life safety renovations for the Britannia Shipyard Building #18 be awarded to Makam Construction Ltd., for the maximum sum of $473,224.

(2)

That the scope of work for the proposed renovations at the Shipyard be increased to include repairs and renovations of the timber piled dock immediately to the west of the Seine Net Loft Building #9 and that this work be undertaken using Human Resources Development Canada (HRDC) workforces and an estimated materials cost of $55.000.

(3))

That an additional sum of $36,500 necessary to complete the proposed structural and life safety renovations to the Britannia Heritage Shipyard Building and dock be authorized, with these additional funds being reallocated from the Minoru Park Fieldhouse project (A/C #45911 - $24,000) and the West Richmond Community Centre Fitness Expansion project (A/C #45917 - $12,500).

ENHANCED AUDIBLE TRAFFIC SIGNALS - PROPOSED IMPLEMENTATION PROGRAM

That the enhancement of the City's current audible traffic signals with a "pole locator" feature be introduced on a trial basis as part of the City's regular Traffic Signal Maintenance Program.

That staff continue to consult the Richmond Committee on Disability and the visually impaired community to monitor the performance and effectiveness of the enhanced audible signals and to identify further modifications if necessary.

VANCOUVER GRIZZLIES AND GRIZZLIES FOUNDATION BASKETBALL COURT SPONSORSHIP PROPOSAL

That staff work in partnership with the Vancouver Grizzlies Foundation and other prospective sponsors to refurbish and resurface the Dolphin Park Basketball Court in the summer of 2000 at no cost to the City.

That $15,000 be allocated from the 2000 Parks Minor Capital for site improvements to expand the existing basketball court at General Currie Park.

(3)

That staff work with the Vancouver Grizzlies Foundation to solicit additional corporate sponsors to expand the existing basketball court at General Currie Park.

BRITISH COLUMBIA POLICING STUDY

That the "British Columbia Policing Study: Project Definition", and the subsequent "Discussion Paper" on the Study (attached to the report dated July 6th, 2000, from Mayor Halsey-Brandt), be received for information.

The question on Resolution No. R00/13-24 was not called, as the following amendment was introduced:

That Resolution No. R00/13-24 be amended by adding the following, "and that the following 12 primary issues which should be addressed in the RCMP study, be endorsed:

(1)

A minimum guaranteed police complement with back-up resource pool to cover short and long-term absences in local detachments;

(2)

A minimum guaranteed duration assignment of uniformed personnel to municipal detachments;

(3)

A minimum guaranteed duration assignment of all senior personnel (officers) to municipal detachments;

(4)

Municipal participation in the selection process for senior detachment personnel (perhaps the OIC and next highest ranking officer);

(5)

Hiring practices which focus recruiting efforts in the local community.

(6)

A financial plan and specific cost control procedures requiring formal municipal approval prior to expenditure;

(7)

A consultation/approval process with individual Lower Mainland municipalities and cities for the establishment of municipal policing priorities and the development of RCMP detachment work plans/service focus;

(8)

A consultation/approval process to allow for municipal input into service level changes (i.e., auxiliary policing) prior to implementation;

(9)

A process which ensures Lower Mainland municipal representation for the upcoming review of the Police Services Contract;

(10)

Direct municipal access to RCMP Detachment financial records - regular accurate budget documentation (actuals);

(11)

Examination of alternative contractual arrangements with individual Lower Mainland municipalities and cities; and

(12)

A separate component within the study to address the Lower Mainland concerns and issues which would be independent from the review of the remainder of the Province."

That the minutes and the Chairs report for the meetings held on June 14th, 2000 and on June 28th, 2000, be received for information.

That the recommendations of the Panel to authorize the issuance of:

(a)

a Development Permit for property at 3100 Francis Road (DP 98-138455); and

(b)

a Development Variance Permit for property at 4671 Duncliffe Road (DVP 00-173936),

be endorsed, and the Permits so issued.

(3)

That the following be deemed to be in general compliance with their respective Development Permits:

(a)

(i)

To reduce the size of the site from 12,592 m (135,546 ft) to 9,671.669 m (104,108.4 ft);

(ii)

To decrease the number of floors from four to three and reduce the floor area from 5,333.389 m (57,410 ft) to 4,197.687 m (45,185 ft);

(iii)

To revise the parking from 263 stalls to 186 stalls; and

(iv)

To revise the site plan and landscape treatment,

for property at 6388 River Road (Development Permit DP 98-153700);

(b)

Introduction of a new driveway access to the Garden City Shopping Centre from Dixon Avenue, for property at 8040 Garden City Road (Development Permit DP 90-214); and
